Want to sue for the return of money but...

I paid up front for a service. Problems have arose over the service provided. The service provider wants to keep money for the service he said he has provided and wants to return the balance to me.

If I accept the money been offered back can I still sue for the other monies?
 
You need to be careful regarding any receipt you give for the part repayment. You should also set out your position in writing reagrading the balance when accepting the partial repayment.

I have seen civil bills and how there is an indorsement of claim plus reliefs included in the body of the bill. Is it the same format for a civil summons?

If you are suing for the return of money owing to a bad service does this fall under a liquidated or an unliquidated sum?
