W8ben form and stockbroker advice

I sold shares in the last week but did not realise that the W8ben form had expired. When I realised it on Monday I contacted the stockbroker who reactivated it but would not give us back the tax deducted on the transaction because the transaction was completed and settled. I contacted the IRS who told me that the stockbroker could make an adjustment on the return and give me back the money as it only recently happened. They said the stockbroker will be reluctant to do it because there is more work in it for them.! I am a customer for over 20 years and it was a genuine error. I have no easy way of getting back the money as I am not a US citizen and will have to wait till next year to file a return and get set up with Tax no's and fill out various forms which I don't have a clue about. Is there anybody who can give me advice on this as I dont seem to be getting anywhere with the broker who would be a fairly big broker handling a very big account for my employment. I live in Ireland
