US Tax Withheld by my US Share Broker

Hi,

I am looking for some general advice regarding tax withheld in the USA.

I have some shares which are managed by the US Broker eTrade.

Whenever I buy/sell shares I ensure I have an up to date W8-BEN form which means eTrade do not have to withhold tax on behalf on the IRS.

I haven't bought or sold shares for a while now and didn't update the W8-BEN form when it expired.

Unfortunately, the company I have shares in paid dividends for the first time in years (I have never known them pay dividends in the 10+ years I have been investing).

I've recently found out they paid these dividends and that I have had tax withheld.

eTrade have said they cannot help me recover this tax and that I should contact my accountant.

My accountant says this tax cannot be recovered in the UK (I wouldn't expect this) but surely I can request a refund in the US?

Does anybody know where I stand on this matter?

Any advice would be gratefully received.
 
As this is an Irish site it is unlikely you will get access to the US/UK taxation law expertise / experience you need.
 
You should be able to reclaim US dividend withholding tax, but you will need to find out what US forms are required.
It may not be worth it, as if you are Irish resident and domiciled you will be taxable in Ireland on the gross income, but get a credit for US tax paid.
Ask your accountant if it will be worth doing.
