If a property is un-registered, the deeds have been mislaid and nobody is living at the address; is it possible for somebody to take vacant possession.

Just because a property isnt registered or has no deeds, and has nobody living it it, it doesnt mean that it isnt owned by someone.

What are you asking?

Can someone walk in and live there? Is there no-one to stop them?
Can someone sell in these circumstances? Can a purchaser/ squatter acquire title?
If deeds are mislaid, it sounds as if someone knows who the owner is.

Vacant possession is the phrase used when selling a property - vacant possession, title and keys in exchange for purchase funds

Thank you both for your replies.

The original owner of the property is now deceased. He left a will leaving the property to his children. The will cannot be established as there is no title. A title is been sought in the land registry for quite some time now.
As there is no title is it possible for someone to walk in and live there?
The family live abroad so they have no one looking after the property.

A Will and title documents do not interact with one another - they are separate things.

So if the original owner left the property to his children, then the children own it. Whether or not title details exist has no bearing on whether or not the children inherit the property. All it means is that there is some additional paperwork that needs to be done in the event of the children wanting to register the land (which isnt required under law) or wanting to dispose of it.

I would imagine that if you walked in and lived there without permission, you would be guilty of tresspass.

Not all land is registered in the Property Registration Authority. Some land, especially in towns, are " Registry of Deeds". That in itself is not a problem, except that it is more difficult to establish who owns it.

See a solicitor about the various complications you mention.
