Unemployment and Back Wages

I, like several other employees, were let go recently from a company. We are all owed between 5 and 7 weeks of back pay. We were sticking around because the owner said he would get financing and pay us the back wages. Should we claim WI umemployment for the period that we are owed back wages? Is that legal and will that hurt my ability to later sue the owner for back wages?
