I have just discovered that I have been under paid in my salary for the last 5 years. In brief I work (job share) form 8.30 till 5.30 but am only paid from 9am. Each Decmeber I receive a payment of € 500.00 which is to cover this extra time. It was done this way as to not effect our hoilday entitlement. Due to some other issues I actually worked out what I should get if I was paid for the half hour each day and it comes to € 883. per year. I have asked for this too be looked at for future payments, but what I would like to know is can I look for this to be adjusted back to 2006 or is it too late ?? The same applies to the girl that I job share with. Many Thanks.
 
Additional hours will only effect your holiday entitlement positively, so you should look into that and claim for any additional leave you may be due in addition to the extra money owed.

There are 3 different ways of calculating your annual leave entitlement:
  • Based on the employee's working hours during what is called the leave year, which runs from April to March. An employee who has worked at least 1,365 hours in the leave year is entitled to the maximum of 4 weeks' annual leave unless the employment ceases during the leave year. Many employers use the calendar year (January-December) instead of the official leave year to calculate entitlement
  • By allowing 1/3 of a working week for each calendar month in which the employee has worked at least 117 hours
  • 8% of the hours worked in the leave year, subject to a maximum of 4 weeks
An employee may use whichever of these methods gives the greater entitlement.
