TV, stand and DVD in Harvey Normans :Cannot get deposit back

Just wondering where I stand on this.

one month ago I chose a TV, stand and DVD in Harvey Normans, it was a package they were doing at a special price. The guy said to me he had none left in stock and to order one and leave €50 deposit and he'd call me when it came in which he estimated to be about 5 working days.

I did that, and 2 weeks later I heard nothing from them. I called and was told that there was a delay with the delivery but that it should be only a few more days and they would call me.

that was 2 weeks ago. In the meantime I bought a TV elsewhere because I had none.

I called them the other day and told them not only am I not impressed that no one has called me even out of courtesy to let me know the status of my order, but that they took money off me and I want it back.

they said deposits are not refundable and if I want I can go up and pick something else, but there is nothing up there I need.

and out of principle I want my money back.
there is nothing on my invoice docket to say that I can't get my money back.

Are they right??

I would ask to speak to the manager and tell him that you are unhappy with the service and unless there is a satisfactory resolution then you will be forwarding your case to the consumer rights association and if it's not resolved at that level you will do whatever it takes to get your money back.

You will get your money back if you cause them grief and give them hassle. I wouldn't give up that easy as a matter of principle.

Harvney Norman are over priced with poor customer service!

to the small claims court with you. They can't tell you after the event that deposits are non-refundable. Did they ever actually offer you what you had paid the deposit for?

Nope, I left the deposit a month ago and have not heard from the since.
I followed up allright but they have not called me at all..

Is there anything on the docket to say that you CAN get your money back? I'd be inclined to assume deposits are non-refundable, unless you have confirmed otherwise.

It does sound like they have messed you around, though. Maybe you could push the issue of their repeated delays with a manager and see what they will do for you.
 
Theres nothing on it to say I can or can't get it back and its an invoice so they should have terms and conditions on it.

I sent in a letter to management, they should have gotten it by now if I get no reply then I'll call again.
 
If you paid a deposit on the understanding that it would be available in 2 weeks and then it was not does that not make the whole deal null and void? They said two weeks you said ok here's the deposit. Two weeks later no product, it that not a breach in itself?
