HI all

I got married in Dec 2003 and my spouse was claiming TRS as a single person on the house. The mortgage was redeemed in Dec 2006 and we then claimed TRS as a married couple.

Question, can I claim back the TRS in respect of the previous mortgage from the date of marriage to the date of redemption? I find revenues terminology, "First time buyer", "First home loan" etc confusing as my name has never been on the deeds or any mortgage held.

Any help would be appreciated.

Thanks

You are unusual as most married people have the mortgage and house in both names.

I suspect you can back claim the TRS but I think that the revenue will be asking some awkward questions about why there is only 1 name on the mortgage.

Can anyone else confirm?

I don't see why one name on the mortgage would be a concern. Lots of people get married and live in a house in only one spouse's name. If I were you I would simply contact Revenue and inquire about backdating the claim for owner occupier mortgage interest relief. I doubt that there will be any problems or inquisitions.
