My spouse passed away earlier this year.
We had accumulated losses on shares not utilised.
If I sell shares before year end can I offset gain against joint losses

I am sorry for your loss, please accept my condolences.

Did you have a joint investment account?
Were all of your shares held jointly?
Did your spouse realise gains in any of the previous three years?

All shares held jointly. Gains in 2019. Not enough to utilise losses

Okay. It’s a while since I looked at this; I’m not 100% sure, but CGT disappears on death, so half of the shares sitting on gains have rebased to their market value, thus eliminating the gains. Unused losses can be carried back for offset against gains in the previous three tax years.

Many thanks,is that market value at date of death?
