Title deeds not sent to the bank

Hi,

We've just gone sale agreed on a house that was a new build in 2022. Now. 2. 5 years later we find out that our bank never got the deeds. I'm presuming that the delay could be with land registry as our house is one of many build in what was a single field. But it could also be with the solicitor who was a bit of a mess during the buying process.

Whatever the reason, it puts us in a difficult position as we are buying another house and had set the timeline based on a straight forward conveyancing.

Could you ask what kind of delays if any we could be looking at? Is this something that a solicitors undertaking could solve?

You need to identify the issue(s) first.
These are some of the possible issues:
1. Ongoing registration issues with Tailte Eireann (formerly the Land Registry)
2. The acting solicitor made a mess and the file is buried somewhere.

I suggest you talk to your current solicitor who is probably best placed to identify potential issues and timelines.

Until the issue is identified and a plan to resolve same is in place, you can't make any plans.

A Solicitor's Undertaking should only be given by a solicitor when it is within their power and control to do what they are being asked to undertake to do.

I have been asked by clients in the past to give Mad Undertakings to fix situations way beyond my power and control to fix.
The sad look of disappointment on their faces when the answer is no .........

I just checked the land registry and it's down as pending, so I guess that's the delay!
