We have been temporarily laid off for the last ten weeks and are now being offered a three day week for the next "twelve weeks" (it doesnt seem like they want to take us back full time yet). Our union had negotiated a 4 week redundancy package in the labour court two years ago. If we look for our redundancy now will we get our 4 weeks or just statutory?? Or will we have to go back on 3 days or can we seek to be put back on 5 days after being temp laid off for a certain period??
All replies would be greatly appreciated as union reps keep giving different answers!!!

I thought you could only be laid off for 4 weeks before they had to offer you redundancy. Open to correction on this though.

You can be laid off for 4 weeks with the RP9 form, then have to return it to the employer stating you wish to claim redundancy and they have a week to get back to you accepting redundancy or offering you a minimum of 13 weeks work within 4 weeks of that date. So technically you could be laid off for up to 9 weeks as long as the company can offer you 13 weeks unbroken work.

It seems though that they are only offering 12 weeks part time though, which to me looks like you would be eligible for redundancy if that's what you wanted. Not sure on the details of the 4 week redundancy package though.
