Looking for advice on a complicated situation
Dad passed in 2019
Mum passed in 2022
They had a significant property that was divided up in to 4 x 2 bedroom cottages, where they rented out 3 of them and lived in the fourth. This was because my dad was in his 80's ill health and mum was in her 60's so could afford to give up work and look after him etc
Anyhow fast forward - she made a mess of her will - etc i won a Section 117 case. Her solicitor was not acting her best interest and still isn't!! just through a high court battle where i got equal share with my sister and a High court order
Anyhow - 2 months before mam passed - a revenue letter arrived looking for an audit of her rental income for previous 4 years from 2018 - 2022. Then mam passed in 2022. Her solicitor is the executor who i have so many suspicions about as he is not giving me or my sister any information
Her solicitor is ignoring all my letters asking for mams accounts, her tenancy agreements, the agreement the solicitor has arranged with the estate agent to manage the estate. Mams house is still being rented out for approx 5,000 a month
Today i get a tax bill from an 'alleged' tax advisor that my mams solicitor engaged - written up on an Excel sheet, no company letter head claiming the estate owes tax amount of 192,00 going back to rent received since 2005. Mams rental income - it is claimed - was all cash
Can Revenue go back this far - how do they know if the properties were even rented then ?? Cos i don't and i remember during the economic crash - there was nobody renting during those dates
For me its figures pulled from the sky as there is no proof from revenue or from mams estate as its a sheer 'guess' that mam actually received this income
The excel document states nothing about mams rental expenses for furniture, ESB, gas bills etc (all mam included all bills) or even to include tax credits or rent a room relief which continues to enforce to me that mams solicitor is again not acting in mams interest and protecting her estate, by minimising her tax liability
It also states that this must be answered in 21 days otherwise the 'tax advisor' will go to revenue and agree 192,000. again no discussion with daughters of the deceased.
This 'tax advisor' is indeed related to the solicitor and a conflict of interest
So Can Revenue go back this far ?
Should i not have visibility of a document or a request from Revenue to go back for 19 years and given its an alleged cash income can this be proved ? I am about to go to Garda as I have serious suspiciions of embezzlement
I have no doubt the estate owes money and i want to pay up what is due - but i have serious doubts around these figures
Can anyone advise ??
