Hi

I am a sub teacher (covering maternity leave) and recently worked as an examiner for one week for Leaving Cert Oral exams.

As I am a sub teacher my school insisted I was responsible to hire in another sub teacher to cover for me during the exams. In addition to getting paid for the exams, the Dept. of Education paid me as normal for the week at school minus my usual PRSI and tax. I offered to pay this Net of tax income to the sub covering for me but she wants to get paid the gross amount and then she will decalre it for tax herself.

Anyway, as I have already paid tax (at 41%) and PRSI on this weeks wages I think if I pay her the gross amount the tax will now be paid twice on the same wage packet.

Can I claim back this tax that is already paid?

Should I register as her employer for the week? If so can I then claim the tax back?

Is there any other way around this?

Sounds awfully convoluted. Is this the way these things are normally arranged!?
 
It is convoluted! Problem is I'm a sub teacher and so the school cannot get a sub in for a sub if you know what I mean. Unfortunately my sub wont accept my pay cheque (cash in hand) she want the gross. Therefore I will have to pay her more than I actually got and therefore pay tax twice on the same pay packet.
 
But surely even if she gets cash in hand then it is still assessable for income tax as her earned income!?
Probably. But If I pay her the gross amount and she pays tax on it again then tax will be paid twice on the same pay packet.
Is there any way for me to claim this tax back?
Is there a year-end form for PAYE taxpayers to claim back money like this?
 
This is a highly irregular, and perhaps illegal, situation. There is no way that the school should be insisting that you should act as an employer to another staff member. You should go back to the school to revoke this arrangement and assuming you are a union member, you should urgently bring this to their attention. Even if you are not a union member, they probably will be interested in helping you.
 
Can you not simply inform the dept of ed that you were not working on the relevant days & get them to reduce your days worked on the next pay cheque to reflect this? The new sub teacher should then get paid for them through the dept of ed as normal. I'm sure it happens regularly enough that substitute teachers get sick etc. and another sub teacher gets called in. This would not be getting a 'sub in for a sub', but a different sub in for the original teacher.
