Me and my now ex partner took out a mortgage in jan 2006. It is a shared ownership with a housing association and we got a mortgage for 50% of the property. We have since seperated-he remains at the property whilst i have moved back in with my family. He refuses to sell and because my name is on this property, i am not able to get jobseekers allowance, which really sucks cos i have no income, whatsoever. I have no funds to instruct a solicitor and am waiting for citizens advice bureau to get back to me with their advice..in the meantime i am wondering if there is anything I can do? I don't think he would be able to take on the mortgage alone (as he wants to do) as he cant get life insurance due to him having Muscular Dystrophy. Can I force a sale? Would I be entitled to legal aid, considering I have no income and no capital (well, apart from the property that is partly in my name..!!) Just dont know what to do..
