I have worked with my existing company for 7 years we have been told we will be taken over by a franchisee in the next 6 months.

TUPE says that the t&c's of my contract move to the new owner.

As my existing company is no longer my employer am I not entitled to redudancy from them before i move to the new owner?

If I am not does my 7 years service cary over to the new owner? and who pays me the redundancy if I am let go with the new franchisee?
 
Your service goes across to your new employer as do your T&Cs unless you agree to sign them away, the exception to this is pensions which are not covered by TUPE

You are not automatically entitled to redundancy, if you refuse to transfer it can be deemed to be a resignation. Your new employers would pick up redundancy costs after the transfer, but there are restrictions as to making you redudant immediately after transfer.
