Are there any circumstances under which a solicitor can swear a statutory declaration for their own client for instance if the document is drawn up by another body. In this case the document was drawn up by Dublin City Council and it is a 7 day notice statutory declaration re fire safety certificate.

A statutory declaration is a statement of fact and needs to be made by the person having knowledge of the facts. It can't be delegated, so an attorney, for example, can't make declarations on behalf of the donor.

In short, no.

What he means is witness the declaration not make it for his client.

Generally solicitors prefer to have an independent person swear the declaration for a number of reasons but I am not aware of the law prohibiting a solicitor swearing a declaration for a client.

Hi there and thanks for your replies. I did mean swearing a document with my clients signature and not make a declaration on their behalf. Sorry for any misunderstanding. It got sorted in the end.
