Bought Aprt off plans four years ago paid my 30%.In the mean time spec of aprt was changed and developer came looking for 10Grand extra eventully settled for five,filled out forms for morgage in budapest and was accepted.
Aprt was due to be handed over last May twelve months but my solictor said there was a small problem which would be sorted out soon.A Couple of months passed and we found out developer had our apart. up for sale but our solictor assured us he couldn't sell it.As it tranpires morgage couldn't be drawn down at time as second phase wasn't finished and deeds couldn't be transferred.
Just the other day I recieved a mail saying the developer has sold my aprt which is one of the better ones overlooking the danube on one of the top floors.
Does anyone know my legal standing as i have no faith in my solicitor who is more interested in the developers interests?
 

I hope you've saved all the emails, letters, ... you got from the developer and 'your' lawyer. Developers in Hungary often create a legal labyrinth of subsidiaries, but you can attack them in a technical way, proving point per point that => 1/ the mistakes came from their side 2/ these errors and delays were the reason of the mortgage problem 3/ the developer (and the lawyer?) expressly misrepresented the situation.
In se you have a strong case, and it's worth fighting for.

Since they have already re-sold your appartment, I would also suggest you find yourself another solicitor. I used to work with Forgo, Varga & Partners and would highly recommend them.

BTW, I also bought two apartmetns in Sun Palace (phase II) and they tried to squeeze some late payment penalty out of me, but it didn't work I could prove that contrary to those stipulated in the pre-sale agreement, they sent me the final notice at a time when the apartment wasn't even ready, had no final occupancy permit, etc.
