Store says I have to pay more

I bought three items of furniture in a well known store a month ago, they were delivered on Saturday.

The coffee table (one of the items) was not the one that I ordered. I contacted the store who informed me that the table that I received was the order number that they sent in and if I needed the other one I would have to pay an extra 200 euro for it as I had paid 375 only and this particular table cost 575 euro. I bought the coffee table that clearly had a big sign stating it was 375.

Essentailly, if I want the table that I bought in the first place I will have to pay the extra even though, they acknowledge that they probably made a mistake in ordering or putting the incorrect sign on it. I am as mad as hell here. I paid them almost 2000 euro and they do this.

Anyone know if I have any comeback here.
 
Tell them they have broken the terms of the contract you made with them and ask them to take back ALL furniture and refund money. Think you will find they will change their tune.

Vanilla thank you for your reply. I have just been on to the manager and I did tell him just that, he quite flatly refuses to take back the other two items, re the contract he states that he would be at a loss and it was just a mistake on the day. I thought there was something legal that if I bought it at the advertised price I had to get it??
 
Of course- you bought a table at a certain price. You are entitled to it or your money back. If you bought all items together so that they would be a matching set you would have a good case for a full return and refund.
 
They don't have to sell at the price advertised as that is an invitation to treat & there is no contract at that point. However - if they accepted your money for that particular coffee table, then, AFAIK, they are obliged to supply the correct table at that price. Does your invoice specify the table ? Did you point straight at the table and say that is the one I want ?

They are probably chancing their arm as so many consumers (& retailers) don;t know the law. Contact the consumer agency so when you call back again you will have all the correct legal phrases to use.

There was only one coffee table on view and I bought that one, when delivered from the company it was a different one completely and therein lies the problem. Yes I will contact consumers tomorrow.Thanks everyone for your help.
 
just to throw in my 2cents worth when you signed the delivery form did you note it on the form if not not all lost but would weakin your case
 
Hi guys just to let you know I got on to consumers and they essentailly agreed with the store it was a human error and if I want the other table I will have to pay the extra 200 euro. I am furious, so be careful what you buy you may end up having to pay more for it after delivery - it sucks.
 
I'm really surprised at this - they supplied you with a coffee table which you did not see, rather than the one you ordered.

I assume they will at least take the unwanted one back & give you a full refund? If you really want the other one, any chance you could suggest, as a gesture of goodwill, that they split the cost difference with you?

Yes Sam they are happy enough to take this one back but they are not happy to split the difference in the money well guess I never will buy anything in Mcgowans again.
 
if that store was any good they would give you the correct table and bite their lip then you would be posting on here how good they were now they will lose a lot more than 200 euro. If I was you I would tell the manager of the shop that you have posted on a website etc.

I was going to go there but wont now.

As an aside you go to a garage to buy a car, you see the one you like, with a price on it, you buy it and await delivery. when it arrives its the wrong car and by the way if you want the one you first ordered it will cost you!!! extra. Nice work if you can get it.

Its unfortunate but it is right, price errors do happen, its how theyre dealt with to satisafaction of customer and shop is where the result lies.

IMO Definitely should have split the difference with you, youre suffering cos of their mistake. Shame on them.
A split 100e wouldnt have hurt them and it would have made all the difference to your shopping experience with them.

definitely mail the salesman, the manager and the owner (if you can find him) this link and post it elsewhere as well, if youre taking all the hit for their mistakes make sure you let the world and his mother know about it. Where are they based? Im out furniture shopping this weekend. I'll know to avoid.
 
Name and shame? You could you PM the compamy name as I am looking to furnish a new house build in the next couple of months and would not want to part with a penny to company like this.
