I am buying a house on my own , sellers are looking for €180000. I previously owned a house with my partner and after we spilt we sold the house. Do I still have to pay stamp duty on the second hand house I am now buying?

You are not a first time buyer. If you buy the property, you will be liable for stamp duty on the price in excess of 125K.

Did you pay capital gains on the property that you sold? I'm not an expert here but think you may be able to offset some of the capital gain made in the property that you sold against the stamp duty for new property...Maybe I am wrong here so would be worth checking with your solicitor

When you say you split from your partner, do you mean legally separated or divorced? If so, then a divorced or separated person can be considered a first-time buyer in the purchase of a subsequent property, if you meet certain conditions. If you were not married to your previous partner then you will not be considered a first time buyer if you have already owned a property.

Not true. There is no offset.

And divorced/separated relief only applies where a divorced or separated spouse continues to live in the original family home. In this instance, they have sold the property. So releif would not apply, if they had been a married couple.
