Stamp Duty for couple, one 1st time buyer, other 2nd time buyer

What are the stamp duty implications for a couple buying their first house together where one is a first time buyer but the other is a second time buyer?

 
If all joint buyers are not FTBs then they are jointly classed as non FTBs in relation to stamp duty and mortgage interest relief as far as I know.

Are there any special situations where a person who is not a first time buyer can avail of first time buyer relief?
Yes. There are two particular situations where a person is deemed to be a first time buyer.
(a) The trustees of a trust (to which section 189A of the Taxes Consolidation Act 1997 applies), whose trust funds are raised by public subscriptions for the benefit of permanently incapacitated persons, in respect of the first house(s) bought after the establishment of the trust, for occupation by the beneficiary or if more than one, each of the beneficiaries.

(b) A spouse to a marriage the subject of a decree of judicial separation, a deed of separation, a decree of divorce or a decree of nullity in the case of the first acquisition of a house by the spouse following the separation or divorce provided that the spouse had, in relation to the former marital home,
  • left that home;
  • not retained an interest in that home;
whose separated/former spouse continues to occupy that home, which home was occupied by both spouses prior to the separation or dissolution of the marriage.
 
im afraid all parties to the purchase must be ftb's. the only way around it is to get married, purchase the property in the name of the ftb then transfer half of the interest to the other spouse free of all taxes cgt stamp duty etc. the end result is the same but no stamp duty was payable on the initial purchase
 
Agree with above unless you buy a new house (are you? not specify in your post) , less than 125sqm and are owner occupier. In that case, FTB or not is not relevant.

Not decided on a new or second-hand house yet but doesn't a second-time buyer pay stamp on a new house anyway?
 
No - FTB and non FTB owner occupier buyers of new houses under 125sqm are exempt from SD as explained above. See .

Thanks ClubMan, I didn't realise non-FTB where exempt from SD on new houses/apts under 125 SqM. I assumed stamp duty applied to both new and second-hand house for non-FTB.
