Hi Everyone,

I'm going to be relocating abroad in January next year. However, I bought my apartment in July, 2007. Therefore, under the stamp duty clawback, I'm not eligible to rent out my apartment until July 2009.

If I rent out my apartment in January 2009, what are the chances of revenue finding out?

Any advice appreciated!

Are your dates correct? It's now August 2008 - did you buy in July 2007?

I don't imagine that anyone here will support you in tax evasion.

That's Revenue's next port of call, I really wouldn't try something like that.

The number of people getting away with not paying the clawback has been quite big over the last number of years. I've heard that Revenue intend on stamp duty being there next project. Just as pension funds and deposit accounts have been.

Not worth it.
