Split from partner trying to sell home

Hi, myself and my partner bought a house last year, we have now broke up. I need advise as it has turned into a royal nightmare... he is currently not paying anything off the mortgage so im left paying the full share. We dont speak at all so everything is through solicitors. He has done so much, eg: cancelled home insurance and life insurance, he ignores bills and hides post!!!

We both don't live in the house anymore so the house is standing idle.... he has bad credit, I myself don't.... The house was on the market at 350,000 which is what we paid I issued a solicitors letter 2 months ago stated I want to reduce it...which he ignored, I now for instruction from my solicitor dropped it down, we are currently not in negitive equity as we put up 90 grand between us.

Worst bit is now he wants to rent the place, I just want rid and have refused, he wanted me to fully furnish the house and maintain it if anything breaks, I told my solicitor no as I do not want my name tied to his any longer than needs be. He has a very bad credit rating and considering he cant even pay insurance what chance have I got. Funny part is he cleared all the contents from the home!!! yet expects me to agree to renting this. We dont have a co ownership agreement so I don't know what to do?? Im just so stressed out I want this house gone!!!

I got an offer offer two weeks ago which would mean the bank is cleared off but we would not get any money back, I was only happy to accept yet still I have heard nothing back from him.

I just don't know how to go about things.

Any advice is welcome.

You have a solicitor advising you so I'm not sure what can be added. Basically you have to go to court to force the sale if your ex does not agree to the sale. You do not have to rent. I would instruct your solicitor to start the court route as it can take a long time to get this sorted out. It's amazing what the threat of a court can do to people and it might make your ex cop on. I would cease to have any dealing with your ex except through your solicitor. Document everything including all payments you make.
 
I disagree with Bronte.

The first thing you (both) need to do is to swallow your pride and start dealing with each other directly, rather than going through solicitors. If I was in your situation, I would turn up on his doorstep and not leave until he speaks to me and you can both come to some sort of agreement.

Second thing, if you're paying off the mortgage, then I don't see any reason why you shouldn't live there. At least that way you'll be getting some benefit for your money.
 
Its too long a story but for what went on I never want to see him again, if it was that simple I wouldnt of hired a solicitor in the first place. He wont agree to anything, I got news today that with a cash injection(which I have) they will allow me to take it over but as the house is in negative equity there is no money to be made, but yet my ex partner feels there is.

I am wondering as I know he(my ex partner) wont allow me to take this over how do I get to that point does anyone know if it would be worth while taking him to court? All I know is this can't go on any longer.
 
When you bought the house, was it a joint mortgage? were both names on the deeds. If this is the case I would check with the bank on his legal obligations on repaying his "share" of the mortgage. You can still protect your own credit rating by keeping the bank informed and also this may put the needed pressure on him to sell. While there is no co- owner agreement, if you both were paying 50/50 and both signed for the mortgage there would be an "implied contract".
The other option would be to give him notice of your intent to sell, which I presume you have, then move it on- he either has to "buy you out" or let you sell. maybe just sign it over to him if you just want to walk away from it.
