Hi,
I live in southern Spain and have just sold a piece of land, with a quite good profit.
However, I seem to be getting mixed information about the CGT liability and this was topped recently by an article in the Sur in English newspaper down here, by Pricewaterhouse Cooper, Malaga office, stating that NON- residents will be classed with residents status if they have lived in Spain for more than 183 days p.a for more than 5 years - which I have.
This is a pretty important point, as a resident only pays 15% CGT whereasa non-resident pays 35%.
Any experts or experienced people out there please?
Incidentally, I have non resident status in the UK for taxes, and I do pay all the other appropriate Spanish taxes and have a 50% share in a properly SL registered Spanish company.
Cheers.
Dave.
