somebody is living in my affordable house!! Please help

I have a deposit on an affordable house since October and there have been the usual unexplained delays yesterday I heard from the council that contracts would be out this week. Like a fool I drove by the house this evening on my way home from work only to see somebody is living in it, not a mistake, curtains up and all there was a kid watching tv in my sitting room!!!!!!! What am I supposed to do ? I am so upset please help me. where does this leave me? Having asked around I established that the person living there is renting from the council not an owner
 
Hi, first of all id speak to the council about why this is happening, once thats established id be pushing for a serious discount on the price, even speaking to a solicitor about what your rights are as you have a deposit paid already, doesn't sound right to me to be honest, thats no longer a brand new affordable house, its an ex council rental property !!! Fact....

Looks like a breach of contract to me. I'd walk away from the deal and look for costs, though I'd have a negative view on the AH scheme in general.
 
Not being funny but are you sure it is your house? Something similar happened to my sister with an AH apartment, we visited it twice to measure and snag and found out a month latter that it wasn't hers, hers was in the next block, exact same apartment (except the correct one was actually in a better location for views!).
 
Certain it is my house but I doubted myself too for a while so I triple checked it is a small development and only one house of that number and I have taken pictures. There is nobody in the housing department until next Tuesday but rang a councillor and he is looking into it, he is mystified. I am so upset over this I did a snag late in 2008 and have paid €6,000 in deposit and €1,500 in admin fees plus valuation for mortgage and snag. I feel like I have been gazumped by the council. I knocked at the door of the house this morning and the woman there confirmed she is renting from the council.
 
Heard back from the council they have offered a different house admitted liability and given a €4000 on price. What do you think of this?
 
I would push for more of a reduction because you will need to pay for and get the snag done again etc and as you said it originally cost you €1500 so the €4,000 is now reduced to a €2,500 reduction. Also there will also be a delay as you will need to go through that whole process again.

Make sure that you like the new house that you are being offered. Is it on the same side of the road? Are there aspects of it that might be different?

Don't accept the first offer. Negotiate or get somebody to do it on your behalf.

They are offering choice of 3 houses on same row but going to see in the morning the senior staff officer meeting me at 8.30. They have offered meeting with "Director" not sure who this person is but I persume it is he I negociate with. I am so upset over this whole thing. I know buying a house is stressful but this is taking the p***. I know I should walk away but I can no longer live where I am living and it is either this or renting.
 
at the risk of sounding smart but with something as serious as this ie new home, hopes dreams etc as im sure in your mind at least you had furniture positioned, colours etc should'nt you really be getting advice from a solicitor. a word of advice though, dont go to the meeting on your own, two heads are better than one , do more listening than talking, remember you have the upper hand as there arent as many takers now for AH as there was 6 mnths ago. SIGN NOTHING be calm and good luck
 
It was a mistake; It happens. They have put their hands up and are doing what it takes to make it right. Try to calm down and not see this as being something done against you. And, obviously, negotiate any advantage that you can.
 
I can well understand that you are upset, as you rightly say moving house is stressful without something like this happening. All I can suggest is, try to be as calm as possible for the meeting tomorrow. Sit down tonight and write down your questions. Think of what is the best outcome from your point of view. Do not rush into any decision. As another poster has suggested, bring somebody with you especially if you are viewing the other houses on offer, it would be good to have another person with you to weigh up which one is best. Very best of luck and I hope that it works out for you.
 
The upside is that you may end up with a better house for a lower price. Focus on achieving that.
