What would be the norm a solicitor would charge for transfering a farm from father to son? Would it be a % of the value of the land?
 
Like most things..........it depends.

Is title in order? Its extremely common to find that title is still registered to an original owner some 75 years ago. Are there tax issues? Are both parties entirely committed to it? Its not unusual to find one more keen than the other and other dragging his feet. Will money change hands? Is son getting a mortgage? Is father retaining a right of residence and maintenance? Will this impact on the mortgage? Etc.,etc.

Best to put your plan of action on paper and approach a local solicitor recommended to you and ask them for a fee quote.

Is it just a straight transfer of land. Both parties are agreed, no tax implications due to agricultural relief. House not included

Does this mean that the solicitor is not being required to undertake any work or give any advice (or assume any responsibility) in relation to the tax situation, or that he\she has given the advice and it is straightforward?
 


It is just a straight forward transfer of the land. No advice sought or given in relation to tax issues as this has been done independently. We are been charged in the region of €9000.00 for the work done. Is this excessive?
 
If :

1. that is a fee (as opposed to a total bill) of €9k and

2. it is indeed just a plain-vanilla transfer (not reserving rights, not creating rights for others, not getting rid of obsolete rights, not dealing with banks, not dealing with taxation etc.) which is as straightforward as was stated,

then the fee does seem high. However, I am with MF1 - the client's definiton of straightforward is not not always based on a proper evalution of what is involved..
