Hi, I've been asked by a good friend to find out about several possible issues relating to redundancy. I've addressed most of them from my own knowledge, but have been unable to figure the remaining problems out...
My friend has worked as a sole trader for the best part of 20yrs. He employed several people over the years and two years ago when he set up a limited company, these employees started working for the limited company.
Their jobs are the same and two of them have been in continuous employment with my friend for 20 yrs and 13yrs respectively.
I've two questions:
1) If they are laid off, what redundancy are they entitled to - 2yrs or 20/13yrs???
2) If the business goes into liquidation and cant pay full redundancy, can my friend be found liable for it personally?? or perhaps for the part with respect to the period when he was a sole trader???
