Revenue officials can and do make mistakes but such mistakes. I would get independent, professional confirmation of this first to be honest.I checked with the Revenue Commissioners and was told that yes, so long as there is an access arrangement in place and the children have overnight access with the non-custodial parent, that parent is entitled to claim the tax credit.
That's my point - you can be! I'm not trying to freak you out but Revenue do make mistakes (maybe and hopefully this is not one) but if they do then they will not accept that as an excuse for mistakes in your tax situation (e.g. misfilings or misclaimed credits etc.).I don't think we can be responsible for their error.
Sounds logical but the tax rules are not always so.Doesn't it make sense though, that he would also qualify as a One-Parent Family. He takes the children every second weekend and he pays maintenance??
I told him if I was ever asked to confirm he takes our child I would not hesitate in telling the truth.
Joe1234, I have thought about it but there is nothing to be gained by it,he's not a very nice person and I couldn't take the chance of them telling him it was me, no doubt i'd pay for it in the long run.
