Seriously Overdue Inheritance Tax

I am one of several beneficiaries in an intestate inheritance case which still hasn't been finalised after nearly 4 years. To date no inheritance tax (c.€200k) has been paid despite our many prompts to the estate solicitor to pay some preliminary tax from the coffers or to at least reassure Revenue that the issue is being addressed.

This is further complicated by the possibility that one of the Administrators may block any attempt to deal with the tax issue (for bizarre reasons outside the scope of this query).

Can the other Administrator and the Beneficiaries write directly to Revenue and advise them of the situation and of their eagerness to address the issue. In other words to squeal on the solicitor and the administrator. When penalties and interest are being dished out, might we get a more compassionate deal?

have you received the inheritance already or is it that the inheritance is tied up and has yet to be released from the estate??
i would say at early doors talk to a well recommended tax advisor but id say he will be limited in his advice unless you actually have the inheritance in hand ready to pay.

before contacting revenue i would try to agree a course of action especially if the other beneficiaries are close family as this type of situation could get messy where people perceive one person contacting revenue on their own to get perceived better treatment.

last point is just wondering is the inheritance tax of c200k an actual figure or your own calculation??

i personally wouldnt have any problem making a complaint with the law society about the solicitor if you feel he is being negligent or at worst exposing you to revenue sanctions.

The Revenue will be paid before the estate is divided and distributed. This seems to be OP's cause for concern in that payment of the tax due is time-limited.

That is unlikely to be the case

I believe the 2nd Administrator needs to contact Revenue as a matter of urgency and explain what is going on (or not as seems to be the case here).

If I were a beneficiary I would be encouraging the 2nd Administrator to do this.

As a beneficiary, OP has no grounds to make such a complaint, as the solicitor acts on behalf of the estate and the administrators.

If the beneficiaries wish to take legal (High Court) action against the administrator(s), they will have to engage their own legal representative.

Why point the finger of blame at the Solicitor when the OP didn't even mention the solicitor as a cause of the problem.
