A friend of mine has left the marital home which is now just
occupied by his wife.He is still part paying the mortgage
because the break up was 'so far' amicable.However he
is worried that he may not be entitled to any of the proceeds
of the sale as he has left the house for over 12 months.Any
advice as to what he should do or what his rights are?

I've heard that myth before and it is just that a myth. People can't be expected to stay living together when they have separated so the party who leaves the family home doesn't lose their rights to it. If he has continued to pay part of the mortgage it is pretty much as if he left yesterday.
