I know that you can be treated as a FTB for stamp duty if you are seperated and meet certain criteria, but can you be trated as FTB for TRS i.e. would you qualify for the higher level?
I think you will qualify for the higher band. You're still recognised as an FTB in the eyes of the state....To be sure, contact the Revenue or a good accountant.

Just an update - as far as I can gather, having rang the TRS offices - you are only entitled to TRS for the first 7 years of your mortgage life, irrespective of any changes in circumstances.
So even if you get your FTB status back for stamp duty it does not apply to TRS.
Having said that the guy I spoke to in the TRS office did not fill me with confidence that he knew what he was on about - but I guess I'll just have to presume that he know he job!!
I know I shouldn't presume anything - but I have gone through everything I can find online and then rang the TRS office - so what can I do - keep ringing the TRS office until they give me a reply that I like?
What you were told is correct; there is an exemption from SD for previously married couples who are now separating. You don't get a second bite of the cherry in regards to TRS however.
But what if you never owned in Ireland ?
I'm seperated soon to move into new home, I've been renting since my return here from the UK 2 yrs ago.
I receive no maintenance etc and with 2 kids it'll be hard enough.
Someone told me there is a "seperated" bracket to claim TRS but like op can't find info anywhere.

If you are FTB then you qualify for the higher rate of TRS (for your 1st seven years of mortgage life)- the fact that you were seperated before you ever bought a house has absolutely no relevance on you getting the higher rate.
I'm sure that I am correct but if it will put your mind at ease you should call the TRS Helpline on 1890 46 36 26 - thats what they are there for (even if they don't fill you with confidence when giving you the information).
