Separation - looking for solution

Hi Everyone

Please help, i am just looking for advise, maybe will get some idea how to resolve this issue.

We are on our 6th year of joint mortgage, outstanding balance 170k, house value around 300k. We have 5 year old child.
Our relationship is over, its been many many years and my ex moved out twice in the past but came back.
our Wages 35k -per year myself, he is on 33k maybe plus tips ( he works in the restaurant)

long story short i offered him
- sale of the house- myself and son come back to my home country - refused
- sale of the house- split 75 x 25 since i am with my son & dog- refused
- help with finding a suitable rent. he has mother who owns the house, but she does not want to take him.
- i want to take the loan to pay him off - he did not like this idea either

as he said he is buying his time in the house, and he wants judge to decide. i am already waiting for legal aid board but that is gonna take around 2 years at least...
He wants 50 x 50 share of house. Cant let this to happened with housing crisis.

i went back to college now doing 2nd degree finance to get a better job to be able take over mortgage soon

i guess my question is what can i do ? does the house need to be sold ?

The house does not need to be sold as long as there is a dependent child living in it.
Though that doesn't help your current living arrangements.
 
I guess there is nothing else I can do. I also offered him two years in the house mortgage free plus 20k and he did also refused.
The living situation is not easy
 
At this point you need to engage a solicitor and start proceedings for divorce.

Be aware this can take up to two years; but you will finally get a resolution & be able to get on with your life.
 
Yes thank you. I am on waiting list for separation with legal aid board
Nothing else I can do just wait

What will be possible outcome in the court? Anyone can help ?

Thank you and thank you for the link to the previous discussion. A bit has changed since then. I guess only court can’t resolve the issue.
