separation from partner, joint mortgage

Hi, I'd like someone to help me out here. I would like a separation from my partner however he doesn't agree to sell the house (joint ownership) or pay me out. According to him, I can just leave and he will then fully own the house. I'd like to know how to deal with this: as I will have to move and rent myself, I wont be able to afford my part of the mortgage, and don't want to pay it when i dont live here anyway. Is there a legal way to get him to agree the sale and what are the implications if i dont pay my part of the mortgage up until the sale? Thanks a mil

How long do you own the house? What did it cost to buy? How much did you borrow? How much is owing now? How much do you think it is worth? Is he epecting you to pay half of the mortgage if you move out or is this something you want to do?
Are you married or unmarried? I would engage the aid of a solicitor in this matter.

hi, house was 290K 4 yrs ago, now worth around 350K, borrowed 266K, now owe 245K. we are not married. i suppose he would like me to pay half of the mortgage but why would i when i want to sell + i will have to pay rent....... thanks for your help

If the house if jointly owned and you are paying half the mortgage then you can't just walk away and do nothing.

If he stops payments on the house you'll be as liable as he is.

Only way around this is that the house should be sold and any remaining money divided up between you and you go your seperate ways.

On your figures the house will clear approc €100k excluding fees, bank charges etc.

Any positive equity you get back from the sale of the house is worth pursuing.

You definitely need to engage the services of a solicitor.

speak to a solicitor. Very likely that once he seeks legal advice in reply to a letter from your solicitor he 'll change his tune.
