My husband and I have separated. We were told by tax office we cannot continue been taxed as a married couple as we have no legally enforceable maintenace agreement. This has total shocked me as it is the first time I ever heard of this?
My question is, if we go back to single tax credits, can we both claim the one parent tax credit. Also as a couple we are in receipt of the incapacitated child tax credit. I was wondering if we both can claim the one parent and split the incapacitated tax credit between the two of us?
I am lone parent and half carer's both are taxable incomes so what happens with these payments will I have to take a decrease in payments?
Any advice would be great as I dont want to ring tax office until I have all my info.

you be both entitle to the one parent tax credit provided both of you's maintain and have access to the child during the year.
in relation to the incapacitated child tax credit why split it between you's as you's are not entitle to the married couple tax credit so why not both of you's claim it !
 
Both of you can claim the One Parent tax credit provided:-

  • The child stays for part of the year (even one night) with each of you
  • You do not live together or with another partner as husband and wife
As you have not stated if you are working we do not know if you will have sufficient tax credits to cover all your income. However if you total income from employment (if you have some) + OPFP + 1/2 Carers is under E528 p.w. you will not have to pay tax. Anything over that is taxable.
