separated - can't get MIS, what options??

Hi Myself and husband have been separated for over a year. For the past few months he has not given any maintenance, is not paying anything towards mortgage, and put a lock on our joint savings. I have been covering the mortgage out of savings and from my income.
I am starting to really struggle to meet repayments now.
I went to CWO to ask about MIS, but she indicated that because his name is on the house it that I won't get it, and that because we have savings we should be using that first.
Is she right? Any advice on what I should do?
Also for MIS, are you supposed to have no savings at all?
This is all turning into a financial nightmare now and I want to avoid missing payments at all costs. This week has actually been hell with other bills coming in, so any constructive advice would be really appreciated.
 
Have you approached the bank to inform them of the situation and ask for interest only period which may help.
I assume that you are in talks with a solicitor in relation to this also.

im in this position aswell, my ex is named on our mortgage, he doesnt give me a red cent towards it and when i applied for MIS, the CWO wouldnt give me the time of day!! She said because he was working (and im on lone parents now) we wouldnt get it and Half of the mortgage was his responsibility! Even though hes paying none of it! They dont take your personal circumstances element into consideration when making decisions, its just calculations to them!
