Selling house with "neighbours from hell"!

Just wondering if anyone knows how something like this works here in Ireland. I want to get my bank to let me sell my negative equity home. Myself & my family have "neighbours from hell", who have been making our lives miserable on a daily basis. The Gardai are involved and we are in the process of getting a barring order on them. They have been racially abusive towards us. This is all noted down in our statements. Its that bad that I'm just willing to hand the keys over to the bank and telling them to keep the house if they don't let us sell. I've just had enough and don't want my family to go through this anymore.

What I want to know is, if I do get the go ahead to sell, do I have to legally declare anything about a dispute with the neighbours to solicitors, the bank etc. Or can I try and sell my house and say nothing about any of this? Just wondering if there would any repercussions in saying nothing about a dispute.

No, you don't need to discuss the problems with neighbours with any proposed purchaser of the property.
handing over the keys to the Bank is not a straightforward option. However, you could look at doing some deal with the Bank, if they permitted the property to be sold. Discuss this with your solicitor and he/she might present a formal proposal to the Bank on your behalf.

If the Purchaser asks you about the neighbours I understand you can't lie has it would leave you liable afterwards. Best not to mention it to the EA at all and then he can't answer the question.

I'm sure its something similar to the law on given a reference on a person.

Maybe someone here that actually knows the law could inform us.

Thanks everyone for the advise. I have written to my solicitor about this today, just hoping they will be able to help.

Well my solicitor advised me to rent out my house until the time that house prices start to go up again. She basically said that the bank wont entertain any idea of trading my mortgage to another house. So we have been in touch with the bank again and more or less said if they don't work something out for us that we are going to leave the house & cease mortgage payments. We are waiting for them to get back to us with an answer.
