SCS - Imaginary Order

Hi,

hopefully this is the right place to look for advice regarding this - apologies if not, I'm new.

I visited SCS with my boyfriend earlier in the summer hoping to get ideas for a sofa for our new house. We did not have exact sizes, but were hoping to get ideas regarding colours, style, etc. We spent a while in the store looking around and had the misfortune to be approached by the store manager. After agreeing that we like one certain sofa she started to talk about creating an order. At this point we advised her that this would not be possible as we weren't sure what size of sofa would fit in to our room having not been in the house yet (it was still being built). She told us that this was not a problem, she could take all of our details and a deposit with no obligation. She would set up an account, but would make it clear that this was subject to our confirmation. Again, she repeated there were no obligations.

We signed an amended set of T&C's - "subject to confirmation" written in block capitals across it. The finance option available to us was explained, but we were advised that it could not be completed as we did not have any identification with us.

We left the store, and didn't think much about it for a few weeks. Eventually we were given access to the new house and immediately realised that the sofa would not be suitable, so we decided not to go ahead.

My partner made a call to SCS stating that we weren't going ahead with the order and we thought that was the end of it.

We since purchased another sofa from another company, but received a call from SCS delivery offices asking where our sofa was to be delivered.

I immediately called the SCS store but was told that the manager had to be the one to deal with us, and that she would be in the following day. We waited patiently for the promised phone call but it never happened, called the store again and was told that the manager wasn't back until the following day. Again, we sat and waited for a call that never happened. Eventually after repeatedly calling the store we were put through to the manager who spoke to us the day we visited.

She firstly agreed that the order was subject to confirmation, and that she did not know the combination we required. She then went to speak to her manager and came back saying that we hadn't cancelled the order.
She then said that we would have to take the sofa and that we should not have bought anything from anyone else. After trying to explain that we didn't have an order, as agreed by herself, I could see I was getting nowhere - the manager put the phone down on me.

We called the finance company and advised that I did not authorise the account to be set up, nor did I take any ID in with me. They have put a note on our account stating this.

We have since received a letter from SCS stating that we have £580 to pay them within 14 days - they are saying that this is 20% of the order?

Can anyone offer any advice regarding this?

You need to put things into writing now & keep it factual (don't personalise any of the information).

Document everything that has happened so far, with specific dates / times, who you spoke to etc. Then, with that information, put a formal letter together, & send it to the manager of the store, stating that you do not owe any money, this issue is now closed and that you expect a response in writing from them within 10 working days stating this.

If you are contacted by phone before you get a letter back, then write down the date, time of call, details of the call & ask the person who you are speaking to for their full name & address of where they are calling from. Make it plain to them that you are noting everything down (can you spell that please, repeat back to them etc).
