Hi,

I am so frustrated as I write this mail and vow never to be naive again -ever.

I left a good job in a small Irish company to take a position in a large multi-national over a year ago. I took a significant pay cut, but was excited about the opportunity so was happy to do so. Though my role is directly for this company, I am paid via a third party company as this was a new business model that "once proven would mean opportunities for me and team colleagues directly with the multi-national". This is a very common model for the mult-national in question. I took the risk and went for it and have worked like a dog for the last year in an effort to prove my ability, but also I take great pride in my work.

The result of this was great - fantastic feedback and the constant carrot of direct employment with the main company. I also took on various tasks and projects over and above the remit of my role so support my colleagues as I was led to believe we were one team and certain rewards would also be open to me.

I have just learned that, although I have worked at 200% with a view to achieving these team awards, I am not eligiable at all and never was. I have also learned that these direct employment opps do not exist in the short term, so I feel like I have been led a merry dance and am now extremely demotivated. While I know that there is nothing I can really do here as I don't work for the company directly, the problem that I now have is as follows:

My employer (the third party) gives me objectives (defined & judged by the direct company) as the basis for a large chunk of salary. On the basis of the mis-sold incentives above, I agreed to certain tough objectives. These are about to be re-set for the next 6 months and I am no longer happy to accept a couple of them. I am mentioned this to both companies and have been told to "look at the bigger picture" (There is none!) and "you have to be flexible".

My issue is that they refuse to set smart objectives and mark my results based on their mood on a given day and how much they deceide to spend. I on the other had, did not sign up to this when I took the job , but am being made feel I am being un-reasonable.

Am I entitled to request the following:
A defined job spec (I have been told to be flexible on this and have doubled over in the last year taking on far to much responcibility, but I want to put an end to this as do over 10 hours unpaid overtime as a result which I now want to stop!)
Clearly defined SMART objectives which are related to my job spec & salary.

For the record, I earn a basic of 30 with an OTE capped of 38K.
My employer mis-sold the package and has changed this several times in the last few months to their benefit, but refused to but it in writing until recently - again I was made feel I was being un-reasonable when I requested this.

Needless to say, I am already job hunting, but as I wil now piss them off by pushing back on tasks outside my role, they will mark me down on my objectives unless I get them resonably defined now.

Any suggestions for she who will not be screwed by an employer ever again!!
 
My reading of this is that you're entitled to ask for a written contract of employment, and
"If your employer fails to give you written details of the terms of your contract, you can bring a complaint to a ."

Yeah - get everything in writing and don't leave it to mutual agreement unless backed up by a clear contractual arrangement.

You were very naive expecting a large multi-national in 2005 to employ you thru a outsourced company (no responsibilties on them), and promise you sun,moon and stars without adding this to your terms and conditions, but thats life , and life moves on.

Your options are quite limited , if you ease up, they will tell you your role will be ceased, and third party firm may say your job is gone, as it was directly related to that role.

As you seem to be getting screwed, unless they make you full-time, moving job is your best option.
