My partner and I (unmarried) are breaking up. She is originally from the U.K and in the heat of arguments has said she will move back there and take our three year old with her. I have Joint Guardianship with respect to our child and wonder what can I do (if anything) to stop her permanently taking our child to another country? It is my understanding that she needs my permission as I have Joint Guardianship.

Legislation applicable includes s16 of The Non Fatal Offences Against the Person Act 1997 which makes it a criminal offence for a parent/guardian to take a child out of the State against a court order or without the consent of each person who is a parent/guardian.
There is also the Child Abduction and Enforcement of Custody Orders Act 1991.
