My partner and I (unmarried) are breaking up. She is originally from the U.K and in the heat of arguments has said she will move back there and take our three year old with her. I have Joint Guardianship with respect to our child and wonder what can I do (if anything) to stop her permanently taking our child to another country? It is my understanding that she needs my permission as I have Joint Guardianship.

talk to a solictor, don't take the word of people on the internet on such an important matter

There are legal recourses available under the realm of family law but as the last poster said you will need to consult with a family law solicitor.

Legislation applicable includes s16 of The Non Fatal Offences Against the Person Act 1997 which makes it a criminal offence for a parent/guardian to take a child out of the State against a court order or without the consent of each person who is a parent/guardian.

There is also the Child Abduction and Enforcement of Custody Orders Act 1991.

Again a family law solicitor will need to be contacted.
