Right of way

Hello everyone im a first timer, just looking for a small bit of info,

Just wondering is there a law for where if you have been using an entrance to a land locked field for a certain lenght of time (eg: over 100 years) do you have right of way to it.

Thanks for any info.
 
Ha Ha nothing like a good auld row over a right of way. These discussions all ways go back to years gone by.

Up to 1st December 2009 there were legal fictions such as "the Lost Modern Grant" as ways to acquire rights of way by prescription, without a deed. However, these were abolished in the Land & Conveyancing Act, 2009. Now, to acquire a right of way by prescription you need a court order under Section 35 of that Act (12 years use for non-state property, 30 for state property, 60 for foreshore), and to register that court order in Registry of Deeds or Land Registry as appropriate.
