Right of Way :: Insurance

My property has a right of way to a forest and when a road to the Forest is built (to extract timber) it will come close to our house... about 30 feet away. Can I compel the Forrester to provide insurance in the event of damage to the house or foundation? Can I get this inserted into his planning permission?
