Right of residancy

Hi there,
I am in the process of selling a house that I have owned for the last 14 years.
Within these 14 years I have never lived in the house but my grandmother did, it was hers for as long as she wanted. She no longer is living in the house.
No legal document from 14 years ago granted her right of residency. Will I now have to get my grandmother to sign over right of residency (she now lives in nursing home) even though it was never 'officially' granted?

It depends.

If the right was informal only, then its not a problem. If it was formal e.g. by way of Will, though and even if it was not formalised on the Title, its likely to be an issue and she will have to consent to the sale/waive her entitlement as appropriate.

Thanks mf1: No formal declaration of right of residency - solicitor in final stages of investigation. Hoping all should be fine!
 
I am sorry to hijack this thread but am having trouble starting a new one.

Question for all the solicitors on here...

Myself and a family member bought our parents home 3 yrs ago, my mother still lives there and has a right of residancy, however in this time i built an extension on and live in this (like a granny flat)

Without going into too much detail we can't keep up this arrangement much longer as my mother has been drinking heavily for the past few months and is violent and unpredictable, my other family member has moved out already as he could no longer take the carry on anymore but has agreed to pay his half of the mortgage till we can sort something out.

We want to see if we would be able to get a injunction which will allow us to put the house on the market or would we be able to do a voluntary repossession.

any advice here would be apreciated.
