Retention of money awaiting planning permission

A Chairde,


A friend of mine has sold his house, but the buyer has added a stipulation , this is to hold back 5K until he gets planning permission to take down the front wall of his house.

It is a corporation house, and my friend knocked down wall without permission 3 years ago, he has contacted the planning dept. of Dublin Corporation, they stated he will have no problems getting permission, and neighbours have no problems .........

Anyone heard of this before, is this sharp practice, or normal ....
 
Your friend could sell to someone else who does not mind that he pulled down a wall without planning permission but it is likely that this purchaser is the highest bidder .

If the purchaser does go ahead with this sale, he can hardly rely as gospel on your friend telling him that he will have no problem now getting this permission.

It is hardly sharp practice to expect a vendor to do now what he should have done before.

Sounds reasonable to withhold money to ensure that what he is buying is what he is getting and that he won't be stuck with the Council making him rebuild the wall! However ensure there is a stipulation that will ensure that he will genuinely try to get planning permission and will not just sit on the €5000 and not apply for the retention.
 
The sharp practice crack comes from the sum of money ... 5000 euro !!!

He has offered to rebuild the wall , but she wants a driveway .....

to rebuild the wall would cost 100 euro all told , it is a terraced house.
