I have a brother who has allowed an other sibling live in a house rent free......as he prefers living in old family home with sister. He wants to make a will re house and savings......he has paid for big works done to house and garden bills.
Daily living bills paid by occupier...occupier has small house elsewhere....summer use.
Question is::
Has the “occupier” any inheritance rights because of rent free status living there .....if owner of house wills it to all surviving siblings ( inclusive of occupier).

Thanks H.

There is something called squatters rights or adverse possession after living in a property for 12 years but the occupier must not acknowledge anyone else as being the owner so it is unlikely that this applies in your case. To clarify matters your brother should get the occupier to sign something acknowledging the arrangement they have made.

It would be better if the owner willed the house to all siblings but gives the occuping sibling a life interest in addition so that she can not be evicted. It would be a sad state of affairs for a sister to find herself turfed out of what is effectively her home. Though the fact she appears to have a house elsewhere might negate this.

If you want your siblings to end up fighting each other do as Bronte suggests.
This sibling has a house so will not be homeless. If you wish to bequeath the property to your siblings do so on a equal basis. It would not be the ideal situation as the property would either have to be sold or shares bought out to enable each beneficiary get the benefit but it would be better than giving one person a life interest in occupancy. He/she could of course surrender this right to enable the property be sold but experience tells me these people get greedy and will want a payoff to agree a sale.
