Rent allowance for ex partner

My ex partner is trying to get rent allowance for an apartment so he can take the kids more.. at the minute he is renting a box room in a house and he is on the housing list. He went to the local welfare officer and was told he needed a court order to say he takes the children, is this true! I dont know if he is just saying that,, but we have never gone through the courts we came to an agreement amongst ourselves about what days he takes the kids..so I dont know where to go from here I dont fancy going to court!!!
 
I dont know weather there is actually anything in writing about needing a court order for the CWO, But i do reckon they would need some form of proof as to wheather or not your ex partner does take the children.

I have a friend who was in a simular situation, he was lving in a one bed apartment and had access to his son for weekends. As his son got older and no longer wanted to share a room with his father , my friend went to his local CWO to see about getting a two bed apt. He was able to show the CWO a copy of his courtorder and was later excepted on rent allowance for a two bed apartment.
 
Evidence of joint custody/visiting arrangements of the children would be a requirement before Rent Supplement could be considered.
 
Thanks Granger and gipimann for getting back to me!!!! Gipimann do you know would he have to take me to court to get a court order as evidence or do they accept any other form of evidence!!!
 
If you agree on arrangements, you may be able to formalise it via solicitors rather than in court, and this would be sufficient evidence to proceed with his claim.
