Removing / Replacing Planning exempt structure

we want to remove an extension at the back of the house kitchen/dining area it has no insulation and the mould and damp are bad. (House has a BER E2 rating) which we are trying to improve ! The extension was built some time ago and was exempt from planning. (Previous owners).
We want to replace like for like (less than 40sqm) and we’re told we did not need planning if this was the case, however if we are removing a planning exempt structure and replacing do we need planning? Thanks

Most likely that planning will not be required, but it would be best to get that confirmed in writing via a Section 5 declaration. Each local authority will have a similar form. Having that confirmation will ensure that any future planning application or sale of the property will process much more smoothly.

Thanks for the info really helpful. Can’t see anything on the Clare council planning forms will call them tomorrow.
