How do I remove a Lis Pendens (LP)from a property? A notice of discontinuance has been issued and served .

If Registry of Deeds property, register it in the Registry of Deeds.

If Land Registry property, see Rule 128(3) of the Land Registration Rules (get the restatement of the rules from the PRAI website).

Thanks for replying. It would have to do with rule 128 (3). Forgive me but I am a lay person and maybe you might help me. I initiated litigation to put a lis pendens on my property to prevent a lien been put on the property. I have now issued and served a notice of discontinuance in relation to this litigation. I now want to remove the lis penens. Is a court order required or can i request the land registry to remove it as it was me that initiated the litigation in the first place.

Rule 128(3) sets out four proofs, one of which is required to remove the lis. In your case it would seem that you could apply to remove it if you provide evidence to the PRAI that it has been discontinued, and an application to remove it.

It would seem that proof 4 of rule 128 (3) has been proven

By proof 4 I mean the last 4 lines of rule 128 (3)
