RE refunds

I bought a dress for my brothers wedding in a boutique less than two weeks ago. When i got it home it did not sit right at the back. I went back to the shop and they said they do not give refunds but would exchange it for me. I dont like any thing else in the shop and the dress was quite expensive. I just want my money back so I can find a dress elsewhere. Do I have any rights to a full refund .

Did you have an opportunity to try it on in the shop (ie - did they have changing rooms)? If they did you have no recourse as it really means you just didn;t like it. As it is they are offering you an exchange, which is more than they have to.

I could be wrong, but there might be some recourse if they had no changing facilities (vaguely recall something about this, but 99% of clothes shops have them these days), but I would reckon it no more than n exchange...which they have offered. Is there anyone you know might like something from the shop & you could sell it to them?

Seems like it was a case of ill fitting since it isnt 'sitting right' and not a fault or flaw with the dress. Sounds like an offer of exchange was quite nice of the shop as they dont have to.

I have a little credit-card sized card with advice from the National Consumer Agency, one of the things it says is "You are not entitled to a refund if you simply change your mind". Also that goods must fit the description given, be fit for their purpose, be of quality fit for sale, match any sample shown and clearly show the full retail price.

On the basis of the above I think you're probably out of luck, but you may find some more useful information on www.consumerconnect.ie
