Refund due from Revenue -- big delay

I submitted an income tax return in October and was due a refund. After a few weeks where they had mislaid the form (it was submitted online by an accountant!) it was found again yet I still havent been sent the refund. Phoned again to be told cheque will be in the post 'in the next week or so'. Is this normal practice?

I think I should be allowed charge them interest and penalties as I'm sure if I was late with a return I would be charged interest and penalties!!
 
Was it a Form 11 for 2007 filed on ROS through the accountant's practice ? If so they can't "mislay" them. The accountant gets an acknowledgement online instantly and the assessment usually issues ( October would be slower admittedly due to the deadlines) in a few days. If there are no other taxes outstanding the taxpayer gets refund in a couple weeks at most.

And yes, if you were late penalties would be applied automatically and interest may apply also.
 
yes it was a form 11 filed online and my accountant told me that revenue couldnt find it. My accountant had to eventually fax over the confirmation page they received when submitting the form to prove it was actually sent! It was only 'rediscovered' a couple of weeks ago.

Am in a similar situation, accountant applied for a substantial refund back in October, but have yet to get refund, accountant has contacted them several times, initially they said it is being processed then believe it went higher up to an inspector. Can it take this long for cgt refunds? even though full documentation was provided.
 

Depending on what you mean by "substantial amount", then yes. Especially in CGT where a desk audit might be carried out before processing.

It is over 15k of a refund, original cgt was paid a few years ago, but we have provided all original documentations and valid documentation for refund.

What is a desk audit? Tks
 

Where an officer goes through the case in detail in Revenue's offices. ( as opposed to a field audit where they call to taxpayers premises to audit the returns )

It might be helpful for your accountant to try get name of who it's gone to. Remember it could be stuck in an "in tray" of someone off sick etc.. It happens.

My accountant has spoken to several people,and believe the case has been dealt with by a couple of people who pass it on to the next stage, he did manage to get to the person dealing with the case at present who said it was being processed, but this was a few weeks ago.

I didn't think it would take this long but you reckon it is not unusual for it to take four or five months?

Previously I would say that's a bit long but in current climate who knows . What might have automatically passed when the coffers were full might just be subject to a teeny weeny bit more scrutiny now.

Totally agree with Graham 07- The coffers are well down and it seems to take a lot longer to get any money back.

If you need the money as soon as possible do at least a weekly phone call to find status of it.

Maybe it is a directive from the top to slow up on repayments? or more repayments now due because of vat refunds and loss reliefs taken effect.

There are certainly more repayments, in a lot of cases 08 Prel Income Tax paid will be excessive being based on 07 and with most 08 results expected to be down refunds will be on the cards. Some employers kept PAY/PRSI dd's the same, employees left so refunds there too. Same is happening with VAt, CGT is almost non-existent at present. There is a big drain on resources. I see these every day and it is becoming worrying.
