Redundant job re-opened

Seeking advice in the behalf of two friends whom had service of 14 & 16 respectively.

Both their positions as waitresses to the restaurant unit of the company hotel were made redundant in Oct' 2008 (statutory redundancy payments were made) however the company has restarted this restaurant of the company...

My question is...am I incorrect in my understanding that there is a clause that if a position is to be made redundant, that position should remain so for a minimum of 12mths. If a position suitable to a previous jobholder (eg exp of 14/16 yrs!!!) that position should unquestionably be offered to the previous jobholders??

As always I stand to be corrected & am greatful for any advice!

I understood it to be 6 months?

No, and anyway unworkable.

There's no set time limit either way. If a job is redundant, that can still be a legitimate redundancy even if a company's fortunes change overnight and they hire people back overnight.
 
I cant see why anyone would complain about reopening a postion that was made redundant? My company did it 2 weeks after we were made redundant - happy days. Got our redundancy and our jobs back
